Compusense Inc. is committed to protecting the privacy of visitors to Compusense on-line panelists. No information will be acquired without the consent of the participant. Consent is the completion and submission of any form to Compusense Inc. Any personal information collected is used only for the purposes for which it was collected, it is not disclosed without authorization or used for personal gain.

This Privacy Policy explains our data processing practices and your options regarding the ways in which your personal data is used.  If you have any requests concerning your personal information or any queries with regard to our processing contact us at panelist@compusense.com.

Information collected

Compusense collects the details provided by you on registration together with information we learn about you from your involvement with Compusense on-line panelists.

We may collect additional information in connection with your participation in any testing offered by us and information you provide when giving us feedback. We also monitor traffic patterns and site use, which enables us to improve the service we provide.

"Personal information" is any information about an identifiable individual and includes race, ethnic origin, colour, age, marital status, family status, religion, education, medical history, criminal record, employment history, financial status, address, telephone number, and any numerical identification, such as Social Insurance Number. Personal information also includes information that may relate to the work performance of the individual, any allegations, investigations or findings of wrongdoing, misconduct or discipline. Personal information does not include job title, business contact information or job description.

Use of your information and your preferences

We will use your information to send you surveys by email and to determine your qualifications for product testing. We will also use your contact details to communicate with you.

Once you have registered to use Compusense on-line panelists, you can change your contact preferences on our welcome page or by contacting us (panelist@compusense.com).

You can unsubscribe from Compusense on-line panelists by clicking on the unsubscribe link or by contacting us (panelist@compusense.com).

Please note that there may be instances where it may be necessary for us to communicate with you, in any event, for administrative or operational reasons in relation to our service.

Disclosures of your information

Your information is used by Compusense Inc. Any personal information collected is used only for the purposes for which it was collected, it is not disclosed without authorization or used for personal gain.

We will never pass your personal data to anyone else, except for any successors in title to our business and suppliers that manage data systems on our behalf both in Canada and abroad. We may also use and disclose information in aggregate (no individuals are identified) for marketing and strategic development purposes.

Any information provided to Compusense Inc. by users of Compusense on-line panelists will be used only by Compusense for the intended purpose as indicated by the form completed. Any information provided to Compusense will be kept secure.

Cookies

"Cookies" are small pieces of information sent by a web server to a web browser, which enables the server to collect information from the browser. You can find out more about the way cookies work on http://www.cookiecentral.com. Compusense Inc. uses cookies for a number of purposes, for instance to enable us to simplify the logging on process for registered users, to help ensure the security and authenticity of registered users and to enable traffic monitoring.

Whilst you do not need to allow your browser to accept cookies in order to browse much of our web site or to access many of our services, you must have cookies enabled if you wish to access any areas reserved for registered users.

Most browsers allow you to turn off the cookie function. If you want to know how to do this please look at the help menu on your browser. As described above this will restrict the online Compusense services you can use.

Access rights

Compusense will provide and update any individual's saved information upon request from the individual.

You have a right to access the personal data that is held about you. To obtain a copy of the personal information Compusense holds about you, please write to us at the following address: Privacy Officer, Compusense Inc. PO Box 1116, Guelph, ON, Canada, N1H 6N3 enclosing your mailingdetails and a cheque for $10 payable to Compusense Inc.

Concerns and complaints

Concerns or complaints related to privacy issues must be made in writing by email to privacy@compusense.com or by mail to Privacy Officer, Compusense Inc. PO Box 1116, Guelph, ON, Canada, N1H 6N3, and be sure to set out the details of the concern or complaint.

Terms & Conditions

  1. Acceptance of Our Terms

    Compusense on-line panelists is provided to you free of charge by Compusense Inc. under these Terms. These Terms govern your use of and involvement in Compusense on-line panelists (whether you are a member or a visitor). These Terms also govern all services provided to you by Compusense Inc. in connection with Compusense on-line panelists.

  2. Amendments

    We may update these Terms from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Compusense on-line panelists website. The changes will apply to the use of Compusense on-line panelists after we have given notice. If you do not wish to accept the new Terms you should not continue to use or participate in Compusense on-line panelists. If you continue to use Compusense on-line panelists after the date on which the change comes into effect, your use of Compusense on-line panelists indicates your agreement to be bound by the new Terms.

    Compusense Inc. may modify or discontinue Compusense on-line panelists with or without notice to you and without liability to you or any third party.

  3. Registration

    All participants in Compusense on-line panelists must be a resident of Canada and aged 18 years or over.

    You will need to register as a member in order to join Compusense on-line panelists and access member areas and information.

    You must ensure that the details provided by you about yourself and your family on registration or at any time are correct and complete.

    You must inform us immediately of any changes to the information that you provided when registering by updating your personal details or by contacting us (panelist@compusense.com).

    Only one registration for Compusense on-line panelists is allowed per person. Any linked child must only be registered once.

  4. Password and Security

    When you register to join Compusense on-line panelists you will be given a password. You will then be able to set your own password. You must keep this password confidential and must not disclose it to or share it with anyone. You will be responsible for all activities that occur under your password. If you know or suspect that someone else knows your password you agree to contact us immediately(panelist@compusense.com).

    If you forget your password please contact us (panelist@compusense.com). We will be able to reset your password if you satisfy our security check.

  5. Compusense on-line panelist - The Scheme

    As a member of Compusense on-line panelists you will be asked to participate in surveys and product tests. Surveys will occur periodically via an on-line questionnaire. Occasionally you may be asked to participate in product tests at our testing facility. When invited to participate in a product test, you will be contacted by Compusense Inc. and you will be briefed about the process and invited to attend.

    In order to stay on the panel, members must answer at least one survey in each year.

    Members of Compusense on-line panelists may be removed from the panel at any time at the sole discretion of Compusense.

  6. Incentives

    We may offer an incentive for a survey or series of surveys successfully completed online. For these surveys the incentive will be communicated in the survey joining instructions.

  7. Intellectual Property

    The content of Compusense on-line panelists is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of Compusense on-line panelists on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Compusense on-line panelists website without written permission from Compusense.

    No licence is granted to you in these Terms to use any trade mark of Compusense Inc. or its affiliated companies.

  8. Disclaimer of Warranties

    Compusense on-line panelistsis provided on an "as is" and "as available" basis. Compusense on-line panelists expressly disclaims all warranties or representations of any kind, express or implied, to the fullest extent permitted by law.

    You understand and agree that Compusense does not guarantee the accuracy or completeness of any information in or provided in connection with Compusense on-line panelists. Compusense is not responsible for any errors or omissions or for the results obtained from the use of such information. Neither Compusense, its employees or consultants, are engaged in rendering legal, medical, counselling or other professional services or advice. Compusense advises you to seek appropriate professional advice or care for any situation or problem that you may have.

    Compusense shall not be responsible for any loss or damage caused directly or indirectly, by the information or ideas contained, suggested or referenced by Compusense on-line panelists. Your participation in Compusense on-line panelists is solely at your own risk. No advice or information, whether oral or written obtained by you from Compusense on-line panelists shall create any warranty not expressly made in these Terms or imposed by law.

    Compusense Inc. makes no warranty that Compusense on-line panelists will meet your requirements, or that the Compusense on-line panelists network will be uninterrupted, timely, secure, or error free; nor does Compusense make any warranty as to the results that may be obtained from Compusense on-line panelists.

    You understand and agree that any material and/or data obtained through Compusense on-line panelists is at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the involvement with Compusense on-line panelists.

  9. Limitation of Liability

    Except as required by law, Compusense shall not be liable for any indirect, incidental, special or consequential losses or damages or loss of profits, data, goodwill, revenue in each case regardless of whether such losses or damages arise in the normal course of events or whether Compusense Inc. has been advised of the possibility of such damages.

    Compusense Inc. will not be liable for any such losses or damages whether arising in contract, tort (including negligence) or otherwise arising out of or in connection with this programme.

    Nothing in these Terms shall operate to exclude or restrict Compusense Inc.'s liability for death or personal injury caused by negligence.

  10. Termination & Remedies for Breach of these Terms by You

    Compusense may suspend or cancel your membership or deny you access to Compusense on-line panelists immediately and at our sole discretion, if you breach any of your obligations under these Terms, or if your use of Compusense on-line panelists is inappropriate or otherwise unacceptable.

    You can cancel this agreement at any time by informing us in writing. If you are a Compusense on-line panelists member you can unsubscribe by using the unsubscribe link or by contacting us (panelist@compusense.com). If you do so, you must stop using Compusense on-line panelists immediately.

    Compusense shall be entitled to disclose your user identity and details if required or requested by the courts or other law enforcement authorities and/or agencies or in such other circumstances as specified in our Privacy Policy.

  11. Indemnification

    You agree to indemnify and hold each of Compusense Inc., its subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of Compusense on-line panelists, the violation of these Terms by you, or the infringement by you, or any other user of your account, or of any intellectual property or other right of any other person or entity.

    You may not use Compusense on-line panelists for any of the following purposes:

    • Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
    • Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
    • Gaining unauthorised access to other computer systems
    • Interfering with any other person's use or enjoyment of Compusense on-line panelists
    • Breaching any laws concerning the use of public telecommunications networks
    • Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner

    Compusense reserves the right to refuse to post material on Compusense on-line panelists or to remove material already posted on Compusense on-line panelists.

    You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgement by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:

    • Any claim by any third party that the use of Compusense on-line panelists by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice
    • Any claim by any third party that the use of Compusense on-line panelists by you infringes that third party's copyright or other intellectual property rights of whatever nature; and any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of Compusense Home Panel Tests by you
  12. Applicable Law

    These Terms shall be governed by and construed in accordance with the laws of Canada and any dispute shall be subject to the exclusive jurisdiction of the courts in the Province of Ontario.

  13. Miscellaneous

    In the event that any provision of these Terms conflict with the law under which these Terms are to be construed or if any such provisions are held invalid by a court with jurisdiction over the parties to these Terms, such provision will be deleted and the remainder of these Terms will remain in full force and effect.

    Any failure or delay by us to enforce strict performance by you of any of these Terms or to exercise any right under these Terms and upon such assignment Compusense Inc. shall be relieved of any further obligation under these Terms.

    Compusense Inc. may assign its rights and obligations under these Terms and upon such assignment Compusense Inc. shall be relieved of any further obligation under these Terms.

    These Terms and the Privacy Policy constitute the entire understanding between you and us as to your use of and involvement in Compusense on-line panelists, and supersede all prior agreements and understandings between us and you. Nothing in these Terms shall operate to exclude or restrict your or our liability for fraudulent misrepresentation.

  14. General

    Compusense on-line panelists is owned and operated by Compusense Inc., a Canadian company whose registered office is located at 255 Speedvale Ave West, Guelph, Ontario N1H 1C5.
